10 Steps to Help Make Your Practice Labor Compliant - Part 3
With employment litigation prevalent, most employers have come to expect that a former or current employee will, at some point, sue or file a complaint. Medical practices have to be more proactive to protect themselves. The following steps may not only help prevent the problem, but better position a medical practice to defend a case brought by an employee, should one arise.
3. Properly Classify Employees. Some employers believe that employees who are paid a weekly salary are not entitled to receive overtime compensation, but this is not entirely true. In order for an employee to correctly be classified as exempt and not entitled to overtime pay, they need to not only receive the requisite salary (the amount of which changed on Dec. 1, 2016), but must also satisfy the applicable duties test. While many practices are aware that managers and administrators may be considered exempt, the application of an exemption hinges on more than just a job title. Actual duties performed are critical to the analysis.

Query: Covering a Colleague's Office
I have a colleague who is recovering from surgery and needs help covering in his office. I would like to help, volunteering my time on a limited basis. Would there be any ramifications if I went to his office to treat his patients and just allow the office to bill under his Medicare number? I am not asking for any remuneration. I’m asking this question more regarding the legality as well as any malpractice coverage or Medicare liabilities.

Response: His staff billing for the services will bill those services just as if your colleague had provided the service. They will add a “Q6” modifier to the claim codes so that Medicare would know a locums (that’s you) was providing this on a temporary basis (no more than 60 days).
This happens a lot and that is very generous and commendable of you to help your colleague like that.

I am glad there has been some discussion here regarding this MIS bunion procedure. I refer to this procedure as a transverse percutenous neck osteotomy. I have been performing this procedure for the past 4 years. I have performed close to 400 of these and have had my share of complications. As with any surgical procedure, once you perform enough of them, you start encountering complications. I have and still continue modifying this procedure to make it better and at the same time, pushing the limits of it. This procedure is extremely powerful. I have performed this procedure on patients of all ages...my youngest patient being 17 and the oldest 82. I have had some minor complications such as pin track infections, and some major such as delayed unions.

Mort and I served on many Board projects many years ago in the Academy of Podiatry Administration. He donated many hours domestically and in other countries rendering podiatry care and education. He was a true "Mensch" to everyone, no matter what their ethnic beliefs were. As a retired Navy podiatrist (Active and Reserve service), I salute Mort for both his Navy service and his professional skill and allegiance to our podiatric profession and our country in particular.

I have a new digital x-ray machine that died on Thursday morning. It won't be fixed at least until Wednesday. Is that one problem, or do I count all of the x-rays I would have taken in that week it was down? The same with my EMR. I had one outage, but it was for an entire day - a lot of patients affected from one problem.
It is scary how much we rely on technology these days. I also had one day when my Internet connection was down, but luckily I was able to use my phone as a hotspot so my computer could access the EMR. Imagine if a company like Practice Fusion got hacked or went out of business.
