IN Podiatrist to Use Forensic Expertise for Upcoming Murder Trial 
 
When law enforcement officers found a man dead inside a Wisconsin motel room, detectives also found a set of bloody bare footprints that didn't match the victim. So Crown Point podiatrist Dr. Michael Nirenberg was enlisted to help tie the footprints to a suspect. Nirenberg said he is scheduled to testify in January about the footprints found at the crime scene. He works at Friendly Foot Care in Crown Point.

Nirenberg said he has worked with various law enforcement officials across the country about footprints, but this is the first case where he is expected to testify during a trial about his findings. Nirenberg said he examined the footprints recovered at the scene, along with footprints taken by officials of Petersen. He submitted a report to law enforcement in Wisconsin.

"Fat" Shoes May Help Ultrarunners But Data Not Yet In: CA Podiatrist
 
There’s no data to support or refute fat shoes because they’re too new, says sports podiatrist Dr. Kevin Kirby. Recently, Kirby gave a talk at the Western States 100-Mile Endurance Race on foot-strike patterns of ultrarunners. Fat shoes, he thinks, could be helpful for ultramarathoners and runners who log an inordinate amount of downhills.

Give fat shoes a try if you think they’ll help, suggests Kirby. Just keep in mind that what works for some doesn’t necessarily work for all.

Agreement Reached on Hiring of New Malta Podiatrists  
 
Agreement has been reached on a timeframe for the engagement of newly graduated podiatrists by the Health Department. The Association of Podiatrists (Malta) had expressed concern that the new graduates were not engaged by the department, despite existing vacancies.
 
However the Association clarified today that its concerns have been discussed and rectified, with an agreement reached on a timeframe of employment for all newly registered podiatrists within the Department of Health.

Some NY Nurse Practitioners Now Freed of Doc Supervision 
 
The new year has brought new regulations for nurse practitioners in New York, many of whom will no longer require a physician's supervision to practice. Nurse practitioners in New York with over 3,600 hours of clinical practice under their belt, beginning Jan. 1, will no longer be required to have a written collaborative agreement with a physician, nor will they be required to submit patient charts to a physician for review. Instead, experienced practitioners will only be required to have an established relationship with a physician or hospital for referral or consultation.
 
The new rules are a part of the Nurse Practitioner Modernization Act, signed into law with the state's budget in April. The law does not change the rules for nurse practitioners with less than 3,600 hours of practice. They will still be required to have a written agreement with a supervising physician. The new rules mean a nurse practitioner with about two years of full-time clinical practice would meet the requirement. New York will join 19 other states and the District of Columbia that have passed similar legislation creating what the American Association of Nurse Practitioners calls “full practice” environments, in which regulations do not reduce or restrict nurse practitioners' practices.

Can a podiatrist in one state who treats an out-of-state patient send an e-prescription to an out-of-state pharmacy?"

Editor's comment: PM News does not provide legal advice. Any podiatrist can e-prescribe to an out-of-state pharmacy. Whether that pharmacy will fill that prescription is dependent on the type of prescription (controlled vs. non-controlled) as well as the specific dispensing rules in that state.

Query: Surgery Coding for Joint Replacement
 
A patient came to our office who had left foot surgery performed (lesser joint replacement with Swanson implants) by another podiatrist. However, the joint implants on the 3rd, 4th, and 5th metatarsals have broken and the implants need to be removed, and either replaced or the joints stabilized by pinning the toes to hold their position while they heal. How do I code these procedure options?

Response: If the implants are removed and nothing else done besides pinning the joint, then I would suggest CPT 20680 (removal of implant; deep), each.  If you are removing and replacing the implants, there is no single code that defines this. You either have to use the removal code, CPT 20680, with or without a "-22" modifier, or use the unlisted foot/toe procedure code, CPT 28899. Note that a number of payers still consider use of lesser metatarsal-phalangeal joint implants as investigational, so pre-authorize the surgery.

RE: Confusing Wording in CMS Attestation Website

While attesting for MU-2 in the CMS website, you will arrive at a place where it will say “completed” in all categories, and the status will be designated as “in progress.” I incorrectly assumed that “in progress” meant that CMS was in progress of sending me the incentive funds. Those words were specifically referring to my actions in completing the necessary attestation documentation. In order to complete the attestation, it is necessary to see the status as both “accepted” and “locked for payment.” I discovered my misunderstanding three months after I thought I had correctly attested.

Dr. Kanadiakis, I am confused by your post. Was I "criticizing" podiatrists, or simply stating the dark but absolute truth? Honestly, I spoke nothing of "competition". I am not threatened by these "others", because they cannot hold a candle to our expertise in podiatry. However, I was speaking directly to the DPMs (and they know who they are) who tell patients that they are covered (when they know damn well that they are not) and bill Medicare for covered services to get the non-covered services paid for. Perhaps it is unique to my area. I don't know, but I have been shown EOBs by many of my patients who insisted that Medicare paid for corns and calluses.
 
One look at the EOB and it is clear to see that RFC does not reimburse over $200 per visit, or $178 per visit, or over $300 per visit from Medicare. That does so much more damage than these billing podiatrists can imagine. If Medicare ever decides to audit podiatrists who see patients every 61 days for non-covered services (coveted by coding for covered services), it ain't going to be pretty. Lest they forget, with EMR, it becomes really easy to audit. 
 
I am not trying to scare anyone. I AM trying to open up a conversation about how podiatry often shoots itself in the foot!
