Michael D. LaCivita, DPM has been named a partner in Podiatry Affiliates, PC. LaCivita is a graduate of a three-year podiatric surgical and medical residency program at the Catholic Health System in Buffalo, where he served as chief resident. He is currently appointed to the teaching faculty of the Podiatric Medicine and Surgery Residency at Sisters of Charity Hospital.

CA Podiatrist Posts $5K Reward for Return of Stolen Rock Albums
 
A podiatrist is offering a $5,000 reward for the return of vintage record albums he says were stolen from his Corona practice. Dr. Jeffrey Katz says someone broke in through the roof of his office over the Thanksgiving holiday weekend and stole several irreplaceable albums, including all eight Led Zeppelin albums, signed by all four band members. The vintage albums were previously locked in a vault, but Katz decided to showcase them in his office and share them with his patients and staff.

Photographs showed that his walls were once lined with some of rock ‘n’ roll’s finest, including The Beatles. Also taken were albums by Fleetwood Mac and Eric Clapton. He went to a lot of the concerts as a young man,” said Sherie Tavernier, a staff member. Katz estimates that the albums are worth $200,000 to $400,000. The albums weren’t insured.

NJ Podiatry Practice Gives Back For the Holidays
 
New Jersey Foot and Ankle Center in Oradell had a busy holiday season of giving.  Patients, employees and community members made generous contributions to their multiple fundraisers. The center collected and donated over 400 pairs of new or gently used shoes to their shoe drive and Charity Holiday Shoe Market. “The Holiday Shoe Market was inspired by the song ‘Christmas Shoes,’” Dr. Dan Margolin said. “We wanted to do our part this season to make lives in need a little brighter and their toes a little warmer.”

The holiday spirit spread through the office, and the front desk employees decided to run a fundraiser for St. Jude’s Children’s Hospital. Lastly, each employee helped to sponsor a child from Court Appointed Special Advocates for Children of Bergen County. They donated over $250 in toys to children in the court system.

QUERIES (MEDICAL-LEGAL)
Query: Obligation to Report Narcotics-Seeking Patient
 
I had a patient come in this week who was obviously seeking narcotics.  After I offered her a script for Ultram, she said that didn't work for her and she suggested Percocet. I contacted her pharmacy and found out she had multiple prescriptions from multiple doctors for narcotics. My questions is do I have an obligation to remain mute and protect the privacy of this patient, or do I have an obligation to report this to some state authority?

Editor's Response: PM News does not provide legal advice. The laws on this vary by state, but typically there is a duty to report such behavior. The following is an example posted by the State Medical Board of Ohio.
 
"A patient using false statements or other deception to obtain narcotics from a physician is engaged in fraudulent and criminal misconduct. If the physician knows that the patient has engaged in felonious conduct and no privilege exists, the physician is required to report the matter to law enforcement. This type of criminal conduct is distinguishable from a physician learning that the patient has engaged in illegal drug use through diagnostic testing or from patient history as part of a legitimate physician-patient relationship.
 
Several courts have held that when an individual is not seeking legitimate medical treatment, the physician-patient privilege does not apply. When a patient engages in fraud in order to obtain drugs from the physician by using false statements, there is no longer a true physician-patient relationship and privilege does not attach to the relationship. See State v. Garrett, 8 Ohio App.3d 244, 247 (10th Dist. 1983). The court further held that the physician-patient privilege applies only to communications that have a relationship to an examination, diagnosis or treatment of the patient’s condition."

I just had my professional chef knife sharpened for $3.00. Does anyone know of a company that sharpens nail clippers, and does not charge $15.00 for that service?  It's almost cheaper to buy less expensive clippers and then throw them away.

Overall, Dr. Kittay's response was well thought out and written. I went to podiatry school with two goals. One was to take care of my patients to the best of my ability, and the second was to take care of my myself and family. Doing an important job well should be financially rewarding. There are many inequalities in our society, but compensating doctors well is not one of them. Everything we do in our office is a "revenue stream." Why are shoes different (assuming that our patients meet the published guidelines)? Without financial success, we cannot survive or better still, thrive, which will allow us to provide a better practice environment for our patients. We can probable outsource a lot of the services we provide. Why stop at shoes?
 
If we are competent in providing a service and it is beneficial to the patient, why should we not provide the service? Why do you assume that our practices cannot be competent in providing shoes? Unfortunately, the payers have adopted an adversarial attitude on almost everything. I do not like it, but it is their game, and for most us, we have no choice but to play by their rules. It makes practice harder, but I believe that most of us can win by taking care of our patients.

Please do not keep potential fraud a secret from the erroneous podiatrist(s), by telling others, but not telling the offender. Inform the erroneous podiatrist(s) and (most importantly) cite valid sources in no uncertain terms. The problem is that a podiatrist might think that he/she has the right or the privilege via the state's podiatry license to experiment on which codes provide the highest reimbursement. A solution might be to send the podiatrist a strong letter by U.S. Certified Mail with a return receipt. The letter must identify the authoritative source and resources, which are in support of the procedure reimbursement code(s) for which podiatrists should be concerned about.
 
A copy should be sent to the state's podiatry association or to the state's podiatric or medical board. The state may or may not take further action on this matter. This approach would have saved my own practice. Just because a podiatrist gets paid does not mean that the reimbursement code(s) and procedure(s) were  legal or correctly processed. In fact, even if a podiatrist attempts to get paid and does not get paid, this can cause a legal issue. Believe me. I had a local podiatrist telling patients and others about my billing practices, yet I was not in the same sort of informed loop. As it turned out, people around me were watching my business practices.

First, I would like to thank Dr. Spinosa for his prompt response, and thank him for his service to the profession. We both have a love for our profession and are on the same side wanting the same things. Having said that, I NEVER "insinuated" that APMA has failed to act on behalf of the profession. I stated "one of the reasons I belong to the APMA is for an organization to offer some sort of protection to our profession." 
 
While it is admirable the APMA has "long advocated" for the various things Dr. Spinosa mentions - my frustration evolves from the fact nothing has changed. How many more years are we going to hear about...
