Alleged Lack of Informed Consent and Causing of DVT

 

Facts: A 62 year-old male plaintiff suffering from gout in his right foot's great toe, claimed he was not properly informed that his surgeon intended to perform a fusion procedure or of the risks of that procedure. He also claimed that the fusion procedure was done incorrectly, causing him to suffer a deep vein thrombosis. The plaintiff required ten months of treatment and rehabilitation in a nursing home following the fusion procedure and suffers limitations and deformity.

Result: Defendant's verdict ($0)
