Ronald Soave, DPM, a member of NYCPM's Class of 1982, replaced the retiring Thomas DeLauro, DPM as Professor and Chair of the Department of Medicine, and has the added title of Dean of the Department. Dr. Soave worked at New York Methodist Hospital from 1985-2017, where he founded the hospital's Podiatry Residency Program and served as Chief of Podiatry. He has been involved with graduate medical education for over 30 years.

What You Need to Know About Office-Based Surgery Laws - Part 1
 
In the past decade, there has been a steady increase in the number and types of surgical procedures performed in an office-based setting by various practitioners – including general surgeons, gastroenterologists, ophthalmologists, radiologists, dermatologists, podiatrists, dentists, and other specialists. While advances in medical technology have enabled more procedures to be performed in an office setting, patient safety concerns remain crucial and warrant a re-examination of legal and regulatory oversight. Practitioners performing office-based surgery (OBS) should be familiar with the laws and leading issues associated with OBS procedures.
 
Although the precise definition varies from state-to-state, an OBS procedure is generally any surgical or diagnostic procedure performed in a physician’s medical office that is invasive or involves subcutaneous penetration, excluding minor surgical procedures. Most jurisdictions classify procedures as “surgical” or “invasive” by reference to the type and level of sedation or anesthesia used.

QUERIES (MEDICAL-LEGAL)
Query: Responsibility for Interpreter When a Hearing Impaired Patient Cancels 
 
I have a situation where a deaf patient was unable to attend his appointment due to bad weather that morning. An interpreter was scheduled for the appointment and arrived at the office. Am I required to pay her services (2 hour minimum plus mileage) when her services were not actually used? He recently rescheduled an appointment with 24 hours notice and she is billing me for this visit also. Can I legally refuse to pay these charges or reverse them to the patient in this situation?

Editor's Response: PM News does not provide legal advice. Unfortunately, under the ADA, physicians are required to pay for an intepreter even if the patient cancels. We have discussed this situation many times in PM News. The consensus solutuion is to schedule the patient at a hospital where you have privileges.

These cases often have tragic results (at least that' s been my experience). I have always opted to call for an orthopedic oncology opinion as they are best equipped to  order/perform  far more sophisticated testing. This is in order to determine whether or not the cancer has spread elsewhere and whether local surgical treatment is worth performing.
 
In all but one case that I had been involved with, the patients all had metastatic spread to vital organs and no surgical procedures were performed. Unfortunately, the 10 or so patients with these types of metastatic spread all passed away in a rather short time.  
 
In only one case was there no other metastatic spread other than to the foot (calcaneus). Chemotherapy took care of the recurrence to the original site (prostate) along with a BKA (as dictated by sentinel node and other biopsies performed by orthopedic oncology). That last patient lived another 20 years and recently passed away at 98.

It is a little bit unsettling to ponder the original query by Name Withheld and the response by Dr. Samimi. It is true that metastatic cancer to the foot (generally considered rare) usually indicates a poorer prognosis, but so does all metastatic disease. MORE IMPORTANTLY, in metastatic disease to the foot, and specifically the nail unit, it is the first knowledge that any cancer exists in the patient anywhere in a way more than casual percentage of cases. In nail units, it approaches 50%. This puts us in a position to get the patient diagnosed and a chance at treatment for the original tumor, even though prognosis is naturally poorer.

I have great respect for Dr. Borreggine’s practices and knowledge, but I do not like the wording and tone of his “Podiatric Treatment Plan”. 
 
Though I am retired and practiced podiatry ‘when Lincoln was a child’, I don’t think people change that much. I always felt the doctor-patient relationship was much different from a customer-business relationship. A relationship with a patient is much more personal than the one they have with their home improvement contractor.

After reading all the articles on valuations of a practice, I would like to try to summarize the topic to ensure we are all comparing apples to apples. The reality is that everyone has given good input but I would like to offer a simple and concise summary of valuation methodologies that will be easy to understand based on real life experience. 
 
There really are no rules of thumb anymore, and selling a practice is like selling any other service business, so it’s important to understand who is buying your practice and then you can come up with a logical formula and rationale for valuing your practice. I think the easiest way to 
start this process is to put your practice in one of three buyer buckets.
