PODIATRISTS IN THE NEWS
Increase in Popularity of Hiking Means More Foot and Ankle Injuries: MA Podiatrist

In the United States, more than 38 million people go hiking annually. "We've all seen hikers accomplishing great feats such as completing the Pacific Crest or Appalachian Trails, and these stories inspire us to undertake more challenging or longer hikes," says Gregory Catalano, DPM, FACFAS, a Massachusetts-based foot and ankle surgeon and Fellow Member of the American College of Foot and Ankle Surgeons.

Dr. Gregory Catalano

"As the number of people hiking increases and they take on more challenging terrain, we are seeing an increase in injuries of all levels of hikers, from Achilles tendon and heel pain to more traumatic injuries including sprains and fractures of the foot and ankle," said Catalano.

PODIATRISTS AND THE LAW
NY Podiatrist Admits Plotting to Kill Wife

A Ramapo podiatrist pleaded guilty Monday to plotting with his lover to try to have his estranged wife killed. Ira Bernstein, 42, of Montebello faces 5 to 15 years in prison when sentenced for felony conspiracy and financial crimes. He planned to have two insurance investigators beaten up to discourage them from bringing fraud allegations about Bernstein's podiatry practice to authorities.

TAX ISSUES
Earlier Due Dates for Forms 1099-MISC and W-2

When a business pays non-employee compensation aggregating to $600 or more to a single payee in a tax year, the business must file a Form 1099-MISC to report the payments to the IRS. Similarly, employers must report wages paid to employees on Forms W-2. Copies of these forms (called payee statements) must also be supplied to payment recipients. Starting with returns for the 2016 calendar year (which must be filed in early 2017), the due date for IRS and SSA filings is advanced to January 31 of the following year. The March 31 due date for electronic filings is no longer available. So the deadline for filing 2016 Forms 1099-MISC and W-2 with the IRS and the SSA is January 31, 2017.

Note: For filing 2016 Forms 1099-MISC and W-2 with the IRS and the SSA, one 30-day extension is allowed. To obtain an extension, you must file Form 8809, "Application for Extension of Time to File Information Returns," by no later than January 31. The deadline to supply payee statements to recipients remains January 31 with no extensions allowed.

PRACTICE MANAGEMENT TIP OF THE DAY
10 Steps to Help Make Your Practice Labor Compliant - Part 8

With employment litigation prevalent, most employers have come to expect that a former or current employee will, at some point, sue or file a complaint. Medical practices have to be more proactive to protect themselves. The following steps may not only help prevent the problem, but better position a medical practice to defend a case brought by an employee, should one arise.

8. Ensure Hiring Protocols Are in Order. To avoid claims of discrimination from the interview process, it is imperative to be aware of those laws that govern such action. For example, medical practices that use job applications should not ask an applicant their age. Should this information be asked and the applicant is denied the job, the applicant may claim the decision was motivated by age. Though the decision may have been based upon an entirely different reason, the fact that the age was requested prevents the employer from having plausible deniability. In addition, certain jurisdictions now prevent inquiries about an applicant's criminal background until after an initial hiring decision has been made.

QUERIES (NON-CLINICAL)
Query: Online Podiatry Store Alternative

With OurDoctorStore.com closing up shop, has anyone found any other similar service to use? I didn't get a ton of use (out of the site), but I think it provides a nice service on my website.

RESPONSES/COMMENTS (NON-CLINICAL)
RE: Help In Reducing Overhead By Passing Some Costs On To Patients
From: Tom Silver, DPM

In reviewing my office overhead for 2016, two items stuck out: 1) $4,342 ($361/mo) in credit card service fees and 2) over $8,000 for MN Care Tax-the 2% tax in Minnesota on all medical services & goods provided to those not on Medicare or a State Health Plan...for a total of over
$12,000 less income!

As a result, when a patient pays with a credit card for orthotics not covered by their insurance plan ($460), we are actually paying a $9.20 tax and almost $15 credit card fee, therefore getting $24-25 less for our services (a 5.25% reduction)! So to actually get $460 for orthotics, I would have to charge about $25.50 more! This also applies to...

Editor's note: Dr. Silver's extended-length letter can be read here.

RESPONSES/COMMENTS (NEWS STORIES)
From: Dennis Shavelson, DPM

When minimalist running, one reduces heel contact running, which for most of us, would be a good thing. Runners must be willing to break in their new stride, speed, and distances slowly to reduce fractures and other overuse injuries such as Achilles tendonitis. These rules apply when breaking any new activity or sport.

The article states, “These days, more of Kirby’s patients are running with thicker-sole shoes than ever before. Every third runner he sees wears Hokas, a sneaker brand with the thickest underfoot cushions in the market today." I must interject that they may be dangerous for many runners. I published a white paper regarding Sketchers Rocker Shoes. I eventually wrote the 41 page brief involved in the successful lawsuit against Sketchers Rocker Shoes involving 300 injuries.

Rockers and flexible soled shoes designed to shock absorb and create cushioning using thick and flexible materials when married to the flexible foot types of many runners, will result in injuries to some of those feet, especially if runners transition too quickly. Rockers obviate the need for healthy internal biomechanics and predictably allow feet with high SERM-PERM Intervals to degenerate to the point that they need rockers all the time. Hokas are unproven short- or long-term as to safety and they are being poorly disclaimed. They are not the next Nike Waffle Trainer yet!
